Please read these Terms and Conditions carefully before using our website or booking any Session with Svaparna Health. By accessing our Site or engaging our services you agree to be bound by these Terms. If you do not agree please do not use our services.
1. About Svaparna Health
Svaparna Health is an integrative health practice founded and operated by Dr. Aparna Sekhar, PT, DPT, a Senior Physiotherapist with over 13 years of clinical experience and a certified Ayurvedic Wellness Consultant.
Svaparna Health offers the following services:
- Physiotherapy Services (Physiotherapy Consultations and Follow-up Sessions) — in person in India and online within India
- Ayurvedic Wellness Services (Ayurvedic Wellness Consultations and Follow-up Sessions) — in person in India and online globally including clients based in the United States
Our website is located at svaparnahealth.com and operates from Mumbai, India.
2. Acceptance of Terms
By using this Site, booking an appointment, or engaging with Svaparna Health in any capacity you confirm that:
- You are at least 18 years of age, or are the parent or legal guardian of a minor client booking on behalf of that minor
- You have read, understood, and agree to these Terms and Conditions in their entirety
- You agree to our Privacy Policy which forms part of these Terms by reference
2A. Specialised Physiotherapy Services for Minors
Svaparna Health offers specialised Physiotherapy Services for children of 5 years of age or older. The following additional terms apply to all consultations involving minor clients.
2A.1 Age Eligibility
Specialised Physiotherapy Services at Svaparna Health for Pediatric Bowel and Bladder issues are available for children aged 5 years and above. We do not offer these services to children under 5 years of age.
2A.2 Parental and Guardian Consent
All Consultations involving a minor require the prior written consent of a parent or legal guardian. By booking a Consultation you confirm that:
- You are the parent or legal guardian of the minor client
- You have full legal authority to consent to health services on behalf of the minor
- You have read, understood, and agree to these Terms and Conditions and our Privacy Policy on behalf of yourself and the minor client
- You have completed the Physiotherapy Intake Form via Google Forms prior to the first Consultation
2A.3 Presence During Sessions
A parent or legal guardian must be present for the entirety of all sessions with a minor — whether in-person or online. We do not conduct sessions with minor clients without a parent or legal guardian present under any circumstances.
2A.4 Health Information Disclosure
The parent or legal guardian is responsible for providing complete and accurate health history and relevant background information about the minor prior to and during consultations. Svaparna Health accepts no liability for any adverse outcome arising from incomplete or inaccurate health information provided on behalf of a minor client.
2A.5 Scope of Specialised Physiotherapy Services for Minors
Specialised Physiotherapy services at Svaparna Health address bowel and bladder concerns in children 5 years of age or older, including constipation, bedwetting, urinary urgency, and related conditions. These services are provided within the scope of Physiotherapy practice and are evidence-based.
2A.6 Safeguarding
Svaparna Health is committed to the safety and wellbeing of all minor clients. If at any point during a consultation Dr. Aparna has reasonable concern regarding the welfare of a minor client, she reserves the right to follow applicable safeguarding protocols, which may include referral to appropriate authorities in accordance with the law.
2A.7 Records and Data
Clinical records for minor clients are retained for a minimum of 7 years following the last consultation or until the minor reaches the age of 25, whichever period is longer. All data relating to minor clients is stored securely within our Google Workspace infrastructure and handled in accordance with our Privacy Policy, Section 10.
3. Nature of Services
3.1 Physiotherapy Services
Physiotherapy Consultations and Follow-up Sessions at Svaparna Health are provided by a Senior Physiotherapist within the applicable scope of practice. These services include clinical assessment, rehabilitation guidance, and therapeutic recommendations for Musculoskeletal, Vestibular, Pelvic Floor, Pediatric Bowel and Bladder, and related physical conditions.
Physiotherapy Services are currently offered online via telehealth for clients within India. In-person appointments in Mumbai, India are coming soon!
3.2 Ayurvedic Wellness Services
Ayurvedic Wellness Consultations and Follow-up Sessions at Svaparna Health constitute wellness, diet and lifestyle guidance only.
These consultations:
- Are not a substitute for medical diagnosis or treatment
- Do not constitute the practice of medicine under any applicable medical practice act in India or the United States
- Are not intended to diagnose, cure, treat, or prevent any disease or medical condition
- Are provided as educational and constitutional wellness guidance based on Ayurvedic principles
- Are available for adults 18 years of age and above only
Clients are advised and encouraged to consult a licensed physician or appropriate medical professional for the diagnosis and treatment of any health condition. Ayurvedic wellness guidance is complementary to and not a replacement for conventional medical care.
3.3 Integrative Approach
Where Physiotherapy and Ayurvedic principles are discussed together within a consultation, the clinical and regulatory boundaries of each modality remain distinct at all times. Physiotherapy services and Ayurvedic Wellness guidance are provided within their respective and separate scopes of practice.
4. Intake Forms and Client Records
Svaparna Health collects client health history and intake information via Google Forms prior to the first consultation. Completed forms are stored securely within our Google Workspace infrastructure.
- Adult clients complete their own Intake Form prior to their first consultation
- For children, the parent or legal guardian completes the Physiotherapy Intake Form on behalf of the minor
- Completion of the relevant Intake Form is a condition of your first consultation — consultations will not proceed without a completed Intake Form
- All information provided in Intake Forms is treated as strictly confidential in accordance with our Privacy Policy
5. Telehealth Services
5.1 Platform: Online Physiotherapy Sessions and Online Ayurvedic Wellness Sessions are conducted via Google Meet. By booking an online session you confirm that you have access to a stable internet connection and a device capable of supporting video consultation.
5.2 Geographic Scope:
- Online Physiotherapy Consultations and Follow-up Sessions are available to clients within India only
- Ayurvedic Wellness Consultations and Follow-up Sessions are available online globally including clients in the United States and India
5.3 Technical Limitations: Svaparna Health is not responsible for service interruptions, technical failures, or connectivity issues arising from your device, internet connection, or third-party platform performance. In the event of a significant technical disruption during a consultation we will make reasonable efforts to reschedule or continue the session.
5.4 Client Jurisdiction Responsibility: It is your responsibility to confirm that receiving Online Ayurvedic Wellness or Physiotherapy Services from a Provider based in India is permitted under the laws and regulations applicable in your location. Svaparna Health does not accept liability for any regulatory non-compliance arising from your local jurisdiction.
5.5 Recording: All sessions are not recorded without your prior explicit written or verbal consent. Unauthorized recording of any session by the client is strictly prohibited.
6. Booking and Appointments
6.1 Scheduling: Appointments are booked through our website via Day Schedule. By booking an appointment you agree to Day Schedule's own Terms of Service and Privacy Policy in addition to these Terms.
6.2 Confirmation: Your appointment is confirmed upon receipt of booking confirmation via email and WhatsApp Business messages and payment of the applicable appointment fee as outlined in Section 7.
6.3 Cancellations and Rescheduling by Client: We require a minimum of 24 hours notice for cancellation or rescheduling of any appointment.
- Cancellations made with more than 24 hours notice will receive a full credit toward a future appointment.
- Cancellations made with less than 24 hours notice and no-shows without prior notice will forfeit the full fee for the appointment.
6.4 Cancellations by Svaparna Health: In the event that Svaparna Health needs to cancel or reschedule your appointment we will provide as much advance notice as possible and offer a full credit or refund of any prepaid fee.
6.5 Late Arrivals: If you arrive or connect more than 15 minutes late to your scheduled appointment the session may be shortened accordingly or rescheduled at our discretion. The full session fee remains applicable.
6.6 Package Validity: All Physiotherapy Session Packages are valid for six months from the date of purchase. Packages are non-transferable and applicable only to the specific Physiotherapy Consultation/Condition for which they were purchased.
7. Fees and Payment
7.1 Consultation Fees: Current fees for all types of appointments are listed on our Home Page and Services page. Svaparna Health reserves the right to update fees at any time. Fee changes will not apply to appointments already confirmed and paid.
7.2 Payment — Indian Clients (Razorpay): Clients based in India pay via Razorpay, our secure online payment gateway. Razorpay is PCI-DSS compliant and regulated by the Reserve Bank of India. Payment is due at the time of booking the appointment. All appointments are managed exclusively through our website. Svaparna Health does not store your payment details — all transactions are handled directly and securely by Razorpay.
7.3 Payment — US and International Clients (PayPal): Clients based in the United States and internationally pay via PayPal. Payment is due prior to the appointment. Svaparna Health does not store your financial details — all transactions are handled directly by PayPal under their Privacy Policy and PCI-DSS security protocols.
7.4 Refunds: All appointment fees are non-refundable once a session has been completed.
7.5 Razorpay Refund Processing: For Indian clients, any applicable refunds will be processed through Razorpay within 5 to 7 business days to your original payment method, subject to Razorpay's refund processing timelines and policies.
8. Client Responsibilities
By engaging Svaparna Health's services you agree to:
- Complete all required Intake Forms via Google Forms prior to your first Consultation
- Provide complete, accurate, and current information regarding your health history, medications, conditions, and any other relevant details prior to and during initial consultation
- Inform your practitioner immediately of any changes to your health status that may affect your care
- Continue working with or follow up with a Physician or appropriate Medical Professional for any condition requiring medical diagnosis or treatment
- Not use Svaparna Health's services as a substitute for emergency medical care
- Engage respectfully and professionally in all communications with Svaparna Health
Svaparna Health accepts no liability for any adverse outcome arising from your failure to disclose complete and accurate health information.
9. No Emergency Services
Svaparna Health does not provide emergency medical services. Our services are not designed or intended for acute, urgent, or emergency care situations under any circumstances. If you are experiencing a medical emergency please contact your local emergency services immediately:
10. Wellness Services Disclaimer
Ayurvedic Wellness Services at Svaparna Health are educational and wellness-oriented in nature. They do not constitute medical diagnosis, medical prescription, or treatment of any kind.
Dietary, lifestyle, herbal, and nutritional suggestions provided during consultations are general wellness guidance based on Ayurvedic principles and your individual constitution. These suggestions should be discussed with your physician before implementation, particularly if you are currently taking prescription medications, have a diagnosed medical condition, are pregnant or breastfeeding, or have known allergies or sensitivities.
Svaparna Health's Ayurvedic Wellness Services complement but do not replace conventional medical care.
11. Health Information Disclaimer
Results from Physiotherapy Services and Ayurvedic Wellness Consultations vary between individuals. Svaparna Health does not guarantee specific outcomes, improvements, or results from any consultation or course of care.
Information shared during the sessions is based on the details you provide and constitutes professional guidance within the applicable scope of practice. It does not constitute a second opinion on any existing medical diagnosis or treatment plan without explicit prior agreement.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Svaparna Health and its founder shall not be liable for any indirect, incidental, consequential, special, or punitive damages of any kind arising from or related to your use of our services or this Site, including but not limited to:
- Adverse reactions to wellness or lifestyle suggestions
- Failure to achieve expected health or wellness outcomes
- Decisions made based on consultation guidance
- Technical failures of third-party platforms used to deliver services
- Unauthorized access to data transmitted through third-party platforms
- Payment processing issues arising from Razorpay or PayPal platform errors
- Data handling practices of Google Workspace, Google Forms, or Day Schedule
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Svaparna Health, its founder, representatives, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses including reasonable legal fees arising out of or related to:
- Your failure to disclose complete and accurate health information prior to or during consultation
- Your failure to complete required Intake Forms accurately and completely via Google Forms
- Your decision to discontinue, modify, or disregard wellness guidance without informing your provider
- Your use of third-party platforms, links, or external resources referenced outside of Svaparna Health's direct control
- Your voluntary sharing of personal health information through unsecured channels including WhatsApp
- Your violation of these Terms and Conditions
- Any claim by a third party arising from your use of our services
14. WhatsApp Business Communication
Svaparna Health uses WhatsApp Business for appointment coordination and follow-up communication. While WhatsApp uses end-to-end encryption, it is not a clinically certified secure communication platform.
By communicating with Svaparna Health via WhatsApp you acknowledge and accept that:
- WhatsApp is not a HIPAA-compliant or clinically certified secure platform
- You voluntarily choose to use this channel for coordination purposes
- Svaparna Health cannot be held liable for any breach of confidentiality arising from the inherent limitations of WhatsApp as a communication platform
For sensitive health information we recommend using our secure professional email channel wherever possible.
15. Day Schedule Booking Platform
Appointments at Svaparna Health are booked through Day Schedule. By using Day Schedule to book your appointment you agree to Day Schedule's own Terms of Service and Privacy Policy. Svaparna Health is not responsible for any technical issues, data handling practices, or service interruptions arising from the Day Schedule platform.
16. Google Workspace and Google Forms
Svaparna Health uses Google Workspace for secure data storage, email communication, and document management. Client Intake Forms are collected via Google Forms and stored within our Google Workspace infrastructure.
By submitting a Google Form Intake Form you acknowledge that:
- Your intake information is collected and stored within Google's secure cloud infrastructure
- Google's data handling is governed by Google's Privacy Policy and Terms of Service
- Svaparna Health maintains access controls limiting client data access to Dr. Aparna Sekhar only
Svaparna Health is not responsible for any data handling practices, security incidents, or service interruptions arising from Google's platforms beyond what is within our reasonable administrative control.
17. Payment Platform Terms
Razorpay (Indian Clients): By making payment through Razorpay you agree to Razorpay's Terms of Service and Privacy Policy. Razorpay is regulated by the Reserve Bank of India and operates in compliance with applicable Indian payment regulations including PCI-DSS standards.
PayPal (US and International Clients): By making payment through PayPal you agree to PayPal's User Agreement and Privacy Policy. PayPal operates in compliance with applicable US federal and international payment regulations including PCI-DSS standards.
Svaparna Health is not responsible for any payment processing errors, delays, or disputes arising from either platform. Any payment disputes should be addressed directly with the relevant payment processor in the first instance.
18. Intellectual Property
All content on this Site including text, graphics, logos, images, and service descriptions is the intellectual property of Svaparna Health unless otherwise stated. No content may be copied, reproduced, distributed, or used for commercial purposes without our prior written consent.
Consultation notes, health recommendations, and written materials provided to you during or following your consultation are for your personal use only and may not be shared, published, or distributed without written permission.
19. Confidentiality
All health information shared with Svaparna Health is treated as strictly confidential in accordance with our Privacy Policy. We will not disclose your personal or health information to any third party except as described in our Privacy Policy or as required by law.
20. Governing Law and Dispute Resolution
20.1 Indian Clients: These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
20.2 US and International Clients: For clients based in the United States, these Terms shall be governed by applicable US federal and state law. Where permitted by law, disputes shall first be referred to mediation before any formal legal proceedings are initiated. Both parties agree to make reasonable good faith efforts to resolve disputes informally before pursuing formal remedies.
20.3 Razorpay Disputes — Indian Clients: Payment disputes involving Razorpay transactions shall additionally be subject to Razorpay's dispute resolution process and applicable RBI guidelines governing payment gateway operations in India.
20.4 General: Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction where necessary.
21. Changes to These Terms: Svaparna Health reserves the right to update or modify these Terms and Conditions at any time. The updated effective date will be reflected at the top of this page. Your continued use of our services following any update constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify existing clients of any material changes via email.
22. Severability: If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms entirely. The remaining provisions shall continue in full force and effect.
23. Entire Agreement: These Terms and Conditions together with our Privacy Policy constitute the entire agreement between you and Svaparna Health regarding your use of our services and supersede any prior agreements, representations, or understandings whether written or oral.
